These Terms & Conditions ("Terms") are an agreement between you and The Change Champions ("we", "us", "our"), the operator of thechangechampions.com and any related pages, emails, and downloads (the "Service").

By accessing or using the Service, you agree to these Terms, our Disclaimer and our Privacy Policy. If you do not agree, do not use the Service. Please read sections 9 to 13 carefully: they limit our liability and affect how disputes are resolved.

1. Who may use the Service

You must be at least 18 years old, or the age of majority where you live, to use the Service. The Service is intended for adults seeking general information and is not directed to children.

2. No medical advice

The Service provides general educational information only. It is not medical advice and does not create any professional relationship. Our Disclaimer forms part of these Terms and applies to all content, tools, emails, and downloads.

You agree that you will consult a qualified healthcare professional before acting on any information from the Service, and that you, not we, are responsible for your health decisions.

3. Our content and your licence

All content on the Service, including text, articles, graphics, illustrations, logos, page designs, the symptom dictionary, and downloadable materials such as the 7-Day Reset Starter Kit, is owned by or licensed to us and is protected by copyright and other laws.

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to view the Service and to download and print our free materials for your own personal, non-commercial use. You may share a link to our pages.

You may not, without our written permission:

• copy, republish, sell, resell, rent, sublicense, or distribute our content or downloads, including by uploading them to other websites, marketplaces, or file-sharing services;
• remove copyright or other notices, or present our content as your own;
• use our content to train, fine-tune, or benchmark artificial-intelligence or machine-learning systems, or scrape the Service by automated means;
• use our name, logo, or branding in a way that suggests endorsement or affiliation.

4. Free downloads and emails

To receive some free materials you may be asked for your email address. You agree to provide accurate information. Free materials are provided "as is" (see section 9) and we may change or withdraw them at any time.

If you choose to receive our newsletter, you can unsubscribe at any time using the link in any email or by contacting us. How we handle your information is explained in our Privacy Policy.

5. Acceptable use

You agree not to:

• use the Service for any unlawful, harmful, or fraudulent purpose;
• submit content that is false, defamatory, harassing, obscene, infringing, or that contains personal health information about someone else;
• give or claim to give medical advice to others through any comment or submission feature;
• interfere with the security or operation of the Service, attempt to access data you are not authorised to access, or introduce malware;
• submit automated or bulk requests, including to our sign-up forms.

6. Things you send us

If you send us comments, questions, feedback, or ideas, you grant us a non-exclusive, worldwide, royalty-free, perpetual licence to use, edit, and publish them (without identifying you unless you agree) in connection with the Service. You confirm you have the right to send them. Please do not send us sensitive health information. We are not able to give personal medical advice.

7. Third-party links and products

The Service may contain links to, or information about, third-party websites, products, and services, some of which may be affiliate links. We do not endorse, control, or accept responsibility for them. Your dealings with third parties are solely between you and them.

8. Changes to the Service and these Terms

We may change, suspend, or discontinue any part of the Service at any time without notice or liability. We may update these Terms from time to time by posting a new version with a new "Last updated" date. Your continued use of the Service after changes are posted means you accept the updated Terms.

9. Disclaimer of warranties

The Service and all content, tools, emails, and downloads are provided "as is" and "as available", without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, and any warranties arising from course of dealing or usage.

We do not warrant that the Service will be uninterrupted, secure, error-free, or free of viruses, that content is accurate or current, or that any information will achieve any particular health result.

10. Limitation of liability

To the fullest extent permitted by law, in no event will The Change Champions, its owners, operators, writers, contributors, affiliates, licensors, or service providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any personal injury, illness, emotional distress, loss of health, loss of profits, revenue, data, or goodwill, arising out of or in connection with the Service, its content, or these Terms, whether based on warranty, contract, tort (including negligence), product liability, or any other legal theory, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability for all claims relating to the Service or these Terms will not exceed the greater of (a) the amount you paid us, if any, in the twelve months before the claim arose, or (b) one hundred US dollars (US$100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above may not apply to you. In those jurisdictions our liability is limited to the smallest extent permitted by law. Nothing in these Terms excludes liability that cannot lawfully be excluded.

11. Indemnity

You agree to defend, indemnify, and hold harmless The Change Champions and its owners, operators, writers, contributors, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your breach of these Terms, or your violation of any law or the rights of any third party.

12. Assumption of risk and release

You understand that health information carries inherent risks if misapplied. You voluntarily assume all risk of using the Service and acting on its content. To the fullest extent permitted by law, you release us from all claims arising from your use of the Service, including claims you do not know or suspect exist at the time of release. If you are a California resident, you waive California Civil Code §1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." Residents of other states waive any similar law.

13. Governing law and disputes

These Terms are governed by the laws of the United States and of the State in which The Change Champions is based, without regard to conflict-of-law rules. Before bringing any claim, you agree to contact us at hello@thechangechampions.com and try to resolve the dispute informally for at least 30 days.

To the fullest extent permitted by law, any claim must be brought in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding, and must be filed within one (1) year after the claim arose, or it is permanently barred.

Subject to the above, you agree to the exclusive jurisdiction of the state and federal courts located in the State in which The Change Champions is based. If you live outside the United States, you may also have rights under the mandatory consumer laws of your country that these Terms do not override.

14. General

These Terms, together with our Disclaimer and Privacy Policy, are the entire agreement between you and us about the Service. If any provision is found unenforceable, it will be limited to the minimum extent necessary and the rest will remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them without restriction. Headings are for convenience only.
